 Must be a human being committing the act
 Sound mind
 Must be over the age of digression (over 10 years old)
 Reasonable creature in being
 A baby is defined as a child when they are born and are a separate being, if
someone punches a pregnant woman in the stomach and she loses the baby,
because it is not born they can only be charged with assault
Murder:
Most serious of all criminal offences
Malice aforethought
 Intent to kill
 Intent to cause grievous bodily harm
Manslaughter:

Infanticide applies where a man or woman kills her own child (in circumstances that would be
murder) by reason of mental disturbance resulting from the effects of giving birth or a disorder
consequent on her giving birth, and the child is under the age of 24 months

who is under the age of six years in circumstances that would be considered manslaughter
