Are offences that one person, or a group of people inflict on another person or another group
of people
Homicide




Killing of one human being by another

Is lawful under the laws of the state
Will not be punished
Such as:
 Death sentence
 Self defence
 Homicide to prevent a murder
 Unexpected death
Unlawful Homicide









Murder that is not legal under the law of the state
Such as:
 Murder

 Culpable driving
Elements to commit an unlawful homicide
 Must be a human being committing the act
 Sound mind
 Must be over the age of digression (over 10 years old)
 Reasonable creature in being
 A baby is defined as a child when they are born and are a separate being, if
someone punches a pregnant woman in the stomach and she loses the baby,
because it is not born they can only be charged with assault

Infanticide applies where a man or woman kills her own child (in circumstances that would be
murder) by reason of mental disturbance resulting from the effects of giving birth or a disorder
consequent on her giving birth, and the child is under the age of 24 months
